Reading your spouses email or text messages might be a misdemeanor in Idaho. If you " knowingly and without authorization uses, accesses, or attempts to access any computer, computer system, or computer network" then you could be charged with Computer Crime. In this day and age it can be easy to think that you could confirm that your spouse is cheating on you by checking his or her email or text messages or facebook account. If you have done so you should speak to an attorney immediately or if you are thinking of doing so you should speak to an attorney immediately. 

 18-2202. Computer crime. (1) Any person who knowingly accesses, attempts to access or uses, or attempts to use any computer, computer system, computer network, or any part thereof for the purpose of: devising or executing any scheme or artifice to defraud; obtaining money, property, or services by means of false or fraudulent pretenses, representations, or promises; or committing theft; commits computer crime.(2)  Any person who knowingly and without authorization alters, damages, or destroys any computer, computer system, or computer network described in section 18-2201, Idaho Code, or any computer software, program, documentation, or data contained in such computer, computer system, or computer network commits computer crime.
(3)  Any person who knowingly and without authorization uses, accesses, or attempts to access any computer, computer system, or computer network described in section 18-2201, Idaho Code, or any computer software, program, documentation or data contained in such computer, computer system, or computer network, commits computer crime.
(4)  A violation of the provisions of subsections (1) or (2) of this section shall be a felony. A violation of the provisions of subsection (3) of this section shall be a misdemeanor.

COMMUNICATIONS SECURITY
 18-6702. Interception and disclosure of wire, electronic or oral communications prohibited. (1) Except as otherwise specifically provided in this chapter, any person shall be guilty of a felony and is punishable by imprisonment in the state prison for a term not to exceed five (5) years or by a fine not to exceed five thousand dollars ($5,000), or by both fine and imprisonment if that person:(a)  Willfully intercepts, endeavors to intercept, or procures any other person to intercept or endeavor to intercept any wire, electronic or oral communication; or
(b)  Willfully uses, endeavors to use, or procures any other person to use or endeavor to use any electronic, mechanical, or other device to intercept any oral communication when:
1.  Such device is affixed to, or otherwise transmits a signal through, a wire, cable, or other like connection used in wire communication; or
2.  Such device transmits communications by radio or interferes with the transmission of such communication; or
(c)  Willfully discloses, or endeavors to disclose, to any other person the contents of any wire, electronic or oral communication, knowing or having reason to know that the information was obtained through the interception of a wire, electronic or oral communication in violation of this subsection; or
(d)  Willfully uses, or endeavors to use, the contents of any wire, electronic or oral communication, knowing or having reason to know that the information was obtained through the interception of a wire, electronic or oral communication in violation of this subsection; or
(e)  Intentionally discloses or endeavors to disclose to any other person the contents of any wire, electronic or oral communication, intercepted by means authorized by subsection (2)(b), (c), (f) or (g) of this section or by section 18-6708, Idaho Code, if that person:
(i)   Knows or has reason to know that the information was obtained through the interception of such communication in connection with a criminal investigation; and
(ii)  Has obtained or received the information in connection with a criminal investigation with the intent to improperly obstruct, impede or interfere with a duly authorized criminal investigation.
